HouseFrame Media — Photo Licensing Agreement & Terms of Use Real Estate Listing Photography & Videography

HouseFrame Media ("PHOTOGRAPHER") retains the copyright for all digital images and video created in the course of doing business and all media on this website. The commissioning real estate broker/agent, property owner, or unlicensed person who is booking ("CLIENT") is granted a license to use the property media, for which they have paid, for the promotion of that property in any media while CLIENT manages the listing. The license expires once the property has Sold, Expired, or is Withdrawn. Media must not be edited or altered by anyone other than PHOTOGRAPHER, with the exception of minor cropping and/or resizing only.

If media is being used for rental purposes, it cannot be used for sale purposes unless another license has been purchased. The service package is based on each individual unit, not the entire building size. If the licensed use is for short-term rentals such as Airbnb, VRBO, Furnished Finder, and/or other platforms that allow furnished rental marketing, the package purchased must be the Short/Mid-Term Rental package rather than the Top Producer listing package. The Short/Mid-Term Rental package includes the right to market for new occupants more than once per year, whereas Top Producer is for occupants on a one-year minimum lease.

CLIENT may NOT give, license, or sell media to anyone. This includes the property owner, other brokers/agents/Realtors, builders, architects, stagers, or any other vendor. Disregarding these terms results in copyright infringement (Digital Millennium Copyright Act of 1998, 17 U.S.C. §512(c)) and may result in legal action. PHOTOGRAPHER recognizes that CLIENT does not control how media is shared by the MLS and syndicated to other listing sites (Zillow, Realtor.com, Redfin, et al.), and CLIENT is not liable for such use beyond license expiration.

PHOTOGRAPHER may re-license real estate media for commercial use by developers, builders, designers, vendors, or other parties. This will be executed under a separate agreement between PHOTOGRAPHER and the licensee.

Payments & Delivery

Payment for imaging services is due on the day of service. If other arrangements are requested, they must be made in writing at least 48 hours before the scheduled time of service.

When full payment is collected at the time of service, PHOTOGRAPHER delivers final photos digitally within 24 hours of the photoshoot start time, and final video within 48 hours. For other payment arrangements, PHOTOGRAPHER delivers within the same time frames following receipt of full payment.

If the invoice is not paid within 7 days of the shoot, an administrative fee of $150 is added to the invoice. Unpaid invoices beyond that point are pursued through standard collections. In the event of a legal dispute in which CLIENT does not pay, CLIENT shall pay all court costs and PHOTOGRAPHER attorney fees.

Cancellations & Weather

Cancellations must be made at least 24 hours before the scheduled photoshoot start time. Shoots cancelled with less than 24 hours of notice are subject to a cancellation fee of 50% of the original invoice amount. The same fee applies if the property is not ready upon the photographer's arrival (see the Real Estate Prep Guide) or if the shoot is cancelled mid-shoot. HouseFrame Media does not deliver partial shoots; the full shoot is rescheduled and completed on a new day.

Weather-related cancellations are subject to the terms above. Some weather conditions can adversely affect exterior photo quality or prevent safe drone flight. In the event of unfavorable weather, the interior photos are captured as planned, and alternate arrangements are made for exterior or aerial coverage; additional fees may apply unless a full cancellation is made at least 24 hours in advance. When the weather is dry but blue skies are not present, PHOTOGRAPHER provides ONE blue-sky replacement on the primary exterior photo at no additional charge. PHOTOGRAPHER may decide to move forward with the shoot in spite of weather conditions.

A CLIENT-requested reshoot after delivery is subject to a flat $80 fee.

Property Condition

CLIENT will ensure that the listing is clean and ready for photography at the time of service. PHOTOGRAPHER is not responsible for cleaning, dusting, changing lightbulbs, or moving furniture, but may adjust window coverings, move small items, or turn lights on/off as necessary. CLIENT shall ensure that there are no hazards to the photographer's safety and that pets are confined out of view. PHOTOGRAPHER will not retouch media to disguise known defects or physical structures — such as wall/floor blemishes, driveway cracks, power lines, etc. — unless agreed to and applicable editing fees are applied.

Additional Terms

Travel fees are waived when the property address is within St. Louis City or St. Louis County. For locations outside these areas, travel fees are calculated at the time of booking, measured from Oakville, MO 63129: $20 for 20–25 miles, $30 for 26–30 miles, $40 for 31–40 miles, and $150 for 40+ miles.

Final media is backed up by HouseFrame Media and is available to be re-delivered for up to 90 days from the date of delivery. Media may no longer be available beyond that time frame. It is recommended that CLIENT keep a local backup to use for the duration of the listing. Once CLIENT's contract with the homeowner has ended (the property is sold or picked up by another agent), the license expires and CLIENT should delete their backup at that time.
